HOMESTEAD LAND HOLDINGS IN KINGSTON ALLOWS DRUNK TO TERRORIZE FEMALE TENANT

ON FEBRUARY 17, 2008 AT 1:05 A.M., SOMEONE POUNDED ON MY DOOR, FIVE TIMES. I CALLED POLICE, WHO WERE THERE IN ABOUT 5 MINUTES. JUST A FEW SECONDS AFTER THE KNOCKING STOPPED, I HEARD THE MALE TENANT IN 506 TALK TO THE SUPER. I ASKED THE SUPER IF HE WAS THE ONE TALKING TO THE TENANT. HE CONFIRMED THAT HE WAS.

THE WITNESS IN 506 SAW THE PERSON WHO WAS POUNDING ON MY DOOR RUN INTO 509. HE TOLD THE POLICE OFFICERS HE SAW THE PERP RUN INTO 509. THE POLICE REFUSE TO DO ANYTHING BECAUSE I WAS NOT PHSICALLY ATTACKED, MURDERED, STABBED, BEAT UP, ETC. THAT I AM GUESSING, WILL BE NEXT! THE POLICE INCIDENT NUMBER IS 08-4527 AND THE ATTENDING OFFICER IS CONSTABLE SILVER. HOMESTEAD REFUSES TO DO ANYTHING EITHER.

THE NEXT DAY I FOUND OUT THAT A PREVIOUS SUPER (BILL GILBERT) WHO WAS FIRED OVER 2 1/2 YEARS AGO FOR PASSING OUT DRUNK WHILE COOKING, RESULTING IN THE FIRE DEPT. ATTENDING ON EACH OF THE THREE (3) OCCASIONS, HAD ILLEGALLY MOVED INTO APT. 509 AT 154 THE PARKWAY, KINGSTON, ON. HE IS LIVING THERE ILLEGALLY, BECAUSE HE IS NOT ON LEASE AND THE TENANT (DAVE VANHOOSER) IS ON ODSP (ONTARIO DISABILITY BENEFITS).

THE TENANT IN 506 ADVISED ME THAT HE HAD NOTIFIED THE RENTAL OFFICE MANY TIMES ABOUT GILBERT LIVING THERE. HE HAS ALSO COMPLAINED ABOUT THE NOISE, WHEN THEY ARE DRINKING AND PARTYING, WHICH IS FREQUENT. THEY WON'T DO ANYTHING ABOUT THAT EITHER, ACCORDING TO WHAT THE TENANT/WITNESS ADVISED ME.

GILBERT BLAMES ME FOR HIS BEING FIRED, BUT IT WAS THE FACT THAT HE PASSED OUT DRUNK WHILE COOKING 3 TIMES THAT GOT HIM FIRED, BUT ONLY WHEN THE FIRE DEPT. CONFIRMED THIS FACT FOR HOMESTEAD. EVEN THEN, IMMEDIATELY AFTER HE WAS FIRED, HOMESTEAD ALLOWED HIM TO LIVE IN 509 FOR MANY MONTHS, EVEN THOUGH NOT ON LEASE FOR THE SAME REASON.

Subject: Someone pounding on my apartment door after 1 a.m./Harassment (Normandy)
Hi Cheryl:

At 1:05 a.m. this morning (Sunday), I was in my bedroom with the door closed, speaking with my sister on the telephone. Someone not just knocked, they heavily pounded on my door 5 times, hitting it very hard several times each time, and taking a break for several seconds between the poundings. Within seconds after the pounding stopped, I heard 2 male voices in the hallway.

My sister was startled, when she heard the noise. I told her I had to go and immediately dialed 911. The person did not speak or shout, and had just pounded on my door.

Immediately after calling the Kingston Police Department 911 emergency number, I telephoned the super, leaving a message on his voice mail. I advised him about the incident and added that I had telephoned the police.

Approximately 5 minutes after calling 911, two police officers arrived here, and I met them at the elevator after "buzzing" them into the building.

The male tenant in 506 entered the hallway, while I was speaking with the officers. He stated that he saw the man, who was pounding on my door. I had advised the officers that, whomever it was that pounded on the door, the person did not use the elevator. I also did not hear the stairwell door, which I usually hear when used. He advised the police several times, that he saw the man, who was pounding on my door. He advised them that he watched the man run into 509 and close the door. I asked him if the man had a moustache and glasses. He replied in the affirmative.

The two officers went to the door, at 509, listening for a few seconds. They then returned to me at the elevator, stating that there was no noise in 509. They did not even knock at the door. They told me to telephone them again, if anything similar occurred. I told the police that there was one person, who matched the description of the person seen by the tenant in 506. It was Bill Gilbert. I advised the officers that I have no contact or trouble, with anyone else in the building. I elaborated that several years ago, Gilbert had been discharged as superintendent. I further explained that on three occasions, he had been cooking while drinking and passed out, prompting visits from the Fire Department. Then, I stated that he blamed me for the loss of his employment. He never told me directly, but several friends of his in the building advised relatives of mine, that he blamed me for his being fired.

While I was speaking with the officers, the super arrived via the stairwell. I asked him whether he had received my telephone message. He advised me that, when I telephoned him, he had been on this floor. He may have been the male, with whom I heard the tenant in 506 speak, after the "pounding" stopped on my door. The super can confirm or deny this fact, since I cannot speak for him. Just as the super and officers were leaving on the elevator, I advised the super that I would be in contact with you, about this incident.

I have no contact with anyone in the building, except for the super. Also, except for making very rare small talk with other tenants/guests/delivery persons (ie. usually a comment about the weather), whose paths I may cross in a common area, I don't even speak with any other tenants in the building. Only twice, since November 1st, have I even spoken with the tenant in 509, and that was when I "bumped into him" on the elevator. On one occasion, we just said "hi" in passing. On the other in early January, as he was entering the elevator and I was exiting, we talked for a minute or two, at which time he told me about the passing of one of his cats and about his visit to his brother's house on Christmas Day. Guess who followed him into the elevator? Well, you would never guess in a million years. It was Gilbert. While Dave and I talked briefly, there was no exchange whatsoever between Gilbert and me, as usual.

There is only one person, who regularly visits Dave in 509, and just like he did when he was the super here, regularly drinks with him. That is Bill Gilbert. He is frequently in the building and I have seen him many times, in common areas or when someone picks him up/drops his off at the front entrance to the building. For example, this past Thursday, I picked up my mail in the lobby. Gilbert came down the stairwell and exited through the front entrance, glancing in my direction as he approached the front door.

Since he was discharged, from his position as superintendent in this building, I do not approach Gilbert in any way, and have not even spoken to him, for some time since before he was discharged. For the record, in no way do I approach, provoke, or antagonize Gilbert in any way. If possible, when I see him, I will even walk in the opposite direction. Even in the months that he lived in 509 after he was fired, I never spoke to him or acknowledged his presence. I turn away when I see him, whether inside or outside the building. It was either the 6th or 7th of March, 2007 when after dinner, accompanied by my boyfriend, I was awaiting the arrival of the elevator. Gilbert exited 509 and came towards the elevator. As he approached, he called out "Hi Sarah". I looked at my boyfriend, immediately turned around, and entered my apartment. You could not even remotely call that a "conversation or mutual exchange". I waited in my apartment, until I heard the elevator clear the first floor and return to my floor. It is the only exchange of any kind, which has transpired between me and Gilbert, since some time before he was discharged as building superintendent.

Is there any investigation, which you can implement, to look into this matter? Please advise me ASAP.

I just found out something very interesting. I wondered why I had been running into Gilbert so frequently, especially over the past few months. It seems that, almost every time I go out, throw out trash, or even check the mail, I see him. As we just discussed, on the phone, when I went to the lobby to check the mail at noon, I spoke with the tenant from 506. He advised me that he has notified your office many times, that Bill Gilbert has been living in Apt. 509 for many months, and obviously he is not on the lease, since that would affect VanHooser's ODSP benefits.

I reiterate from my previous e-mail and my conversation with you about this incident, I have NOT spoken with Gilbert since some time before he was discharged. Shortly after he was discharged, I heard from several sources that he blamed me for his being fire. Whenever I see him in the building or on the grounds, I avoid him, moving in the opposite direction if possible. I don't converse with, approach, provoke, antagonize, challenge or confront him.

I was unaware that similar things had occurred to other tenants. That does not mean, however, that it was not Gilbert. Just before you returned my call, I contacted KPD. The incident number is 08-4527 and the attending officer was Constable Silver. You may wish to confirm with him that the tenant in 506 told the attending officers and me that he saw the male, who was pounding on my door, run into Apt. 509. They should also be able to confirm that, when I asked if the male had a moustache and glasses, he said that he did. I did not specifically ask whether it was Gilbert. I was frightened and in shock, as you may well imagine. Until the conversation today, I was not sure whether the tenant in 506 even knew who Gilbert was. The police are not investigating this matter. It is an investigation they apparently are leaving up to you. At the very least, if you bother to confirm with police, that the party was seen running into 509, you should be able to issue a warning to VanHooser, because at the least a guest of his harassed another tenant. This was, at the least, a serious case of harassment. Only a spineless coward would do something like that to deliberately terrify a middle-aged woman, who lives alone. At the same time, Gilbert is definitely aware of your policies and knew that you would essentially do nothing about it.

I think it is safe to say that, especially in light of the incident on February 17th, that you have put me in a very dangerous situation, by allowing Gilbert to live here. Should something like this recur or something more sinister happen (ie. I am attacked - incidents involving alcoholics who harbour grudges do escalate), I vow that if I can't find a way to sue you and Homestead Land Holdings for putting me in such danger, I will at the least definitely find a way to publicize it.

I spoke with Michael this morning, about the incident. As I told him on the phone, Gilbert is the only person at 509 who has issue with me. VanHooser moved into the building several months before I did. He and I have never had problems. As I told you, he gave me a hug for Christmas when I bumped into him in early January. I do know some of Dave's guests, but none of them have ever bothered me. I knew that he had a roommate who was not on lease, since he has had a roommate like this almost all of the time since his Dad passed away a few years ago, but did not know it was Gilbert.
